Lieberman May Seek to Ban Big Commodities Investors (Update2)

June 18 (Bloomberg) -- Senator Joseph Lieberman, a
Connecticut independent, issued a proposal that could ban
institutional investors with more than $500 million in assets
from buying commodities.
A second proposal would limit the share of commodities held
by investors across all exchanges and a third would impose
position limits on financial investors not engaged in ``bona
fide'' commodity investing. Lieberman didn't guarantee that any
one proposal would be in final legislation.
``There is a key distinction between speculation and
excessive speculation, and we are going to try to define that,''
said Lieberman, who will draft final legislation with Maine
Republican Senator Susan Collins.
The proposals come one day after Walter Lukken, the
chairman of the Commodity Futures Trading Commission, announced
plans to regulate trades made on Intercontinental Exchange
Inc.'s ICE Futures Europe the same as it does New York
Mercantile Exchange transactions.
Lieberman's measure would be one of at least five proposed
in the Senate to try to curb any speculative effects on the
price of commodities.
Investment groups struck back at the congressional
proposals, sending a letter to lawmakers today, cautioning them
not to over-regulate financial services. Proposals to raise
margin requirements, ban speculation or alter international
agreements may undermine markets, the letter said.
Blaming price swings on traders could lead them to abandon
regulated exchanges ``and use their investment dollars
elsewhere,'' said the letter from the International Swaps and
Derivatives Association, the Futures Industry Association and
the Securities Industry and Financial Markets Association.
``Such an exodus threatens the healthy functioning of the
markets and the economy.''

`Toughest' Proposals

Collins expressed doubt about banning institutional
investors. ``If we do restrict institutional investors, are we
ending up hurting retirees and the beneficiaries of pension
plans?'' Collins said. ``That's an issue that we need to get
more comment on.''
``I believe this is the toughest set of proposals with
regard to the impact of market speculation on food and fuel
prices that have yet been introduced in the Senate,'' he said.
Oil touched $139.89 for the first time June 16, while the
average pump price of gasoline was $4.082 a gallon, according to
an Energy Department weekly report the same day.
Also June 16, corn futures for December delivery reached
$7.915 a bushel on the Chicago Board of Trade, the highest ever
and the eighth record in as many trading sessions.

それにしても5億ドルって言うと結構小さなファンドまで入りますね。まあこういう法案が通るとはとても思えないのですが、ブッシュ大統領に寝返った元民主党の大物(現在は無所属)がこういうことを言い出したり、CFTCが動き出したり、アメリカでもそれなりに問題意識があるということは認識しておく必要があるでしょう。

日和見主義と言ってしまえばそれまでかもしれませんが、リーバーマン上院議員はマケイン上院議員に政治的に極めて近い立場にあり、上院では非常に影響力のある中道政治家です。ファンド規制が、大衆迎合的な思いつきから、本格的な検討課題に議論が移行してきたと見るべきではないでしょうか
